The following information is extracted from 加州 Education Code sections 68000 and after, as well as 加州 Administrative Code Title V, sections 54000-54072.

Each student at the time of admission or returning to Butte College (after being absent for one semester or more) will be classified according to his/her legal residence. Evidence 五月 be required to prove physical presence in 加州 and intent to make 加州 the permanent home.

住院医生实习期 determination shall be made as of the first day of the semester of application.

学生s wishing to have their residency re-evaluated are welcome to submit their 完成 residency re-evaluation form and required documentation or submit an AB540 加州 Non-resident Tuition Exemption request and education transcripts during our regular business hours.

1. Obtain physical presence in 加州 one year and one  day prior to the residency determination date.
Note: The one year period begins when you are not only present in 加州 but also have demonstrated clear intent to become a permanent resident of 加州.

Acceptable evidence of physical presence:

• Owning residential property or continuous occupancy of rented or leased property in 加州
• Current registration to vote and voting in 加州
• Having a current license for a 加州 business
• Showing 加州 as a home address on State or Federal tax forms for the previous 两年
• Evidence of 加州 employment for the last 两年
• 成绩单 from a 加州 high school or college for the last 两年

2. Demonstrate a clear intent to make 加州 your permanent place of residency:
(No one factor is controlling.)

Acceptable evidence of intent:

• Possessing 加州 driver's license
• Possessing 加州 motor vehicle license plates
• Establishing and maintaining active 加州 bank accounts
• Holding active membership in service or social clubs
• Utility bills (gas, water, power, telephone)
• Documentation of credit agreements with Califoria businesses

3. Not be involved in conduct inconsistent with a claim of 加州 residency.
Note: Butte College considers these above all others:

• Maintaining voter registration in another state
• Being a petitioner for divorce in another state
• Attending an out-of-state institution as a resident of that state
• Declaring non-residency for state income tax purposes
• Maintaining a driver's license and/or vehicle registration in another state

Special residency rules: There are special residency rules which 五月 apply in the following cases:

• Veterans/Active Duty Military Member and Dependents
• AB 13 (VACA) Exemption or Veterans Access, Choice, and Accountability Act (VACA H.R. 3230)

- Immigrants Rising CA Nonresident Tuition AB540 Facts

Any student, other than a nonimmigrant alien, who meets all of the following requirements, shall be exempt from paying nonresident tuition at the 加州 社区 Colleges, the 加州 State University and the University of 加州.

• The student must have attended a high school (public or private) in 加州 for three or more years.
• The student must have graduated from a 加州 high school or attained the equivalent prior to the start of the term (for example, passing the GED or 加州 High School Proficiency Exam)
• An alien student who is without lawful immigration status must file an affidavit with the college or university stating that he or she has filed an application to legalize his or her immigration status, or will file an application as soon as he or she is eligible to do so.
• 学生s who are nonimmigrants [for example, those who hold F(student) visas, B(visitor) 签证等.] are not eligible for this exemption.
• The student must file an exemption request including a signed affidavit with the college that indicates the student has met all applicable conditions described above. 学生 information obtained in this process is strictly confidential unless disclosure is required under law.
• 学生s eligible for this exemption who are transferring to another 加州 public college or university must submit a new request (and documentation if required) to each college under consideration.
• Nonresident students meeting the criteria will be exempted from the payment of nonresident tuition, but they will not be classified as 加州 residents. They continue to be "nonresidents".
• AB 540 五月 provide undocumented students with eligibility for state financial aid programs and 奖学金. These students remain ineligible for federal financial aid

Some students 五月 qualify for an AB 540 waiver. This waiver entitles students who qualify to have their non-resident fees waived for the semester.

Procedures for Requesting This Exemption from Nonresident Tuition

Complete the 加州 Nonresident Tuition Exemption Request. Submit to the e世博官方网站 and 记录 办公室 after you have enrolled in classes. You are required to submit education transcripts to validate requirements with your 完成 exemption request form.
